Motion to Suppress Evidence in Unlawful Search


A defendant aggrieved by an unlawful search and seizure may move to suppress anything obtained, for use as evidence because;

  1. the property was illegally seized without a warrant,
  2. the warrant is insufficient on its face,
  3. the property seized is not the property described in the warrant,
  4. there was no probable cause for believing the existence of the grounds on which the warrant was issued, or
  5. the warrant was illegally executed.

Every Motion to Suppress evidence shall state clearly the particular evidence sought to be suppressed, the reasons for suppression, and a general statement of facts on which the Motion is based.
